General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) are part of the registration and apply to the 5Rhythms Festival 2022 in Ruppertshofen.
Participant
The offer to participate is open to all interested persons from the age of 18. Participants are responsible for themselves. Participation in this event is at your own risk and is not a substitute for therapeutic or psychological treatment.
Registration
Registration is only possible via the website or the registration form, which can be downloaded here. Registration must be received by the registration deadline of 15 July at the latest. You will receive a confirmation of registration after we have received your completed registration form. With the confirmation of the registration, a contract is legally binding. The registration is deemed to be completed as soon as the organiser has received the corresponding amounts. If the event or parts of it are fully booked, a written cancellation will be sent. Registrations will be considered in the order in which they are received and are only valid if they contain the required information. Confirmations for day and evening tickets will only be made after the early bird discount has expired, provided that places are still available.
Withdrawal of the participant
The participant may withdraw from the contract at any time up to the start of the event by submitting a written declaration to the organiser. The cut-off date is the date of receipt of the withdrawal declaration by the organiser. In each case of withdrawal by the participant(s), the organiser shall be entitled to the following lump-sum compensation, taking into account any expenses usually saved:
In the event of withdrawal by May 31st 2022: € 25.00
Cancellation by June 30th 2022: € 75.00
In the event of withdrawal by July 15th 2022: € 125.00
In case of withdrawal after the registration deadline or non-participation without cancellation 100% of the participant fee. The participant fee is made up of the festival prices according to the announcement and the prices of the accommodation chosen by the organiser.
We would like to point out that non-participation in the event without an express written declaration of cancellation does not constitute withdrawal, but in this case the participant remains obliged to pay the full cancellation fee.
Only temporary participation in an event does not entitle the participant to a reduction of the respective price. The same applies to spontaneous meals not taken.
If a substitute participant can be named in the event of withdrawal, who will also take the place, a fee of € 25.00 fee will be due. The amounts already paid remain with the organiser.
Payment
After the confirmation of registration, you will receive an invoice for the participation fee by e‑mail; the due date is stated on the invoice. The organiser has the right to withdraw from the contract if payment is not made on time. The guest house will issue a separate invoice for accommodation/meals.
Services not used
If the participant does not make use of individual services due to late arrival or early departure or due to other reasons for which the organiser is not responsible, a proportional refund is not possible.
Cancellation by the organiser/change of program
The organiser may cancel the event and withdraw from the contract if the required minimum number of participants has not been reached or if it is not possible to hold the event, for example, due to restrictions imposed by the Corona Ordinance, because a speaker who is important for the success of the event is unable to attend due to illness or other reasons for which the organiser is not responsible, or because the rooms are not available as a result of force majeure. The organiser reserves the right to change the festival program, e.g. by offering appropriate substitutes for 5Rhythms teachers who are unable to attend or by postponing the schedule. In case of cancellation by the organiser, the paid fees will be refunded minus a fee of 25,00 € each.
Accommodation
Accommodation in the guest house will be in the room categories shown in the program. If you are unable to find a room in one of the BVW buildings, you will find information about the possibilities of independent accommodation on the website.
Pets
Pets are not allowed on the premises. Companion dogs for the disabled are exempt from this rule. The owner is liable for any damage caused by the disabled companion dog brought along. The bringing of a disabled companion dog is to be notified with the registration.
Staying overnight in a tent or car
Overnight accommodation in a dormitory or in a tent brought along is only possible to a limited extent on the premises of the Berufsvorbereitungswerk Ostalb gGmbH. Together with the confirmation of registration you will also receive information as to whether such accommodation is still possible.
Liability
Any liability of the organiser and its auxiliary persons for personal injury or damage to property is excluded, except in cases of intent or gross negligence. Participation in the event implies acceptance of this exclusion of liability. The organiser is not liable for service disruptions, personal injury and property damage in connection with services that are merely arranged as third-party services.
If the organiser is forced to cancel an event, there is no entitlement to the event being held. Nor can the organiser be obliged to compensate for travel or accommodation costs, loss of working hours or other claims. No liability shall be accepted for indirect damage, in particular loss of profit or claims by third parties.
Liability for parked cars and brought-in objects
Insofar as a parking space is made available on the organisers premises, this shall not constitute a custody agreement. The organiser shall not be obliged to monitor the parking area. The organiser shall not be liable for damage to the vehicle caused on a parking space provided.
The organiser shall not be liable for damage, loss or theft of property or valuables brought in or brought along by the guests. Items left behind will only be returned upon request and at the expense and risk of the participant. The organiser undertakes to keep the items for two months.
Limitation of actions, data protection
Claims of the participant against the organiser, irrespective of the legal grounds — however, with the exception of claims of the participant in tort — shall become statute-barred one year after the contractually agreed date of the end of the event.
Personal data of participants will be carefully protected by the organiser. They are used to process the event and the booking procedures. Furthermore, the data will be used to send information material from the organiser. Beyond that, personal data will not be passed on to third parties without consent.
Validity
All information on dates, prices, services and programs is correct at the time of going to press. We expressly reserve the right to make changes. Only written agreements are valid. No liability is accepted for printing errors. Should any of the above provisions be or become invalid, the remaining provisions shall nevertheless remain valid.
Organiser
The organisers are Dagmar Hanke/Andreas Ritter, Leintalstr. 5, 73568 Durlangen in cooperation with the Berufsvorbereitungswerk Ostalb gGmbH. The place of jurisdiction is the organisers registered office.
