General Terms and Conditions (GTC)
These General Terms and Conditions (GTC) are part of the registration and apply to the 5Rhythms Festival 2024 in Ruppertshofen.
Participant
The offer to participate is open to all interested parties aged 18 and over. Participants are responsible for themselves. Participation in this event is at your own risk and is not a substitute for therapeutic or psychological treatment.
Registration form
Registration takes place via the registration form on the website. Registration must be received by the registration deadline on July 15 at the latest. You will receive a confirmation of registration after we have received your completed registration form. Confirmation of registration constitutes a legally binding contract. The registration is considered complete as soon as the corresponding amounts have been received by the organizer in due time after invoicing. If the event or parts of it are fully booked, a written cancellation will be sent. Registrations will be considered in the order in which they are received and are only valid if they contain the required information.
Commitments for evening tickets will only be made after the early booking discount has expired, provided that places are still available.
Withdrawal by the participant
The participant may withdraw from the contract at any time up to the start of the event by submitting a written declaration to the organizer. The effective date is the date of receipt of the declaration of withdrawal by the organizer. In each case of withdrawal by the participant(s), the organizer shall be entitled to the following flat-rate compensation, taking into account the expenses usually saved:
For withdrawal by May 31, 2024: € 50.00
In the event of withdrawal by June 30, 2024: € 75.00
In the event of withdrawal by July 15, 2024: € 125.00
In the event of withdrawal after the registration deadline or non-participation without cancellation: 100% of the participant fee The participant fee is made up of the festival prices according to the announcement and the prices of the accommodation and meals selected by the organizer.
We would like to point out that non-participation in the event without an express written declaration of withdrawal is not considered a withdrawal, but in this case the participant remains obliged to pay the full cancellation fee.
Participation in an event for only part of the time does not entitle the participant to a reduction in the respective price. The same applies to spontaneously missed meals.
If a substitute participant can be named in the event of withdrawal who also takes the place, a fee of € 50.00 will be charged. The amounts already paid remain with the organizer.
Payment
With the registration confirmation you will receive an email listing the bookings with the amounts to be transferred to the organizer; the due date is noted on the registration confirmation/invoice. The organizer has the right to withdraw from the contract if payment is not made on time. The guest house will issue a separate invoice for accommodation/meals. This will be sent during the month of June.
Services not utilized
If the participant does not make use of individual services due to late arrival or early departure or for other reasons for which the organizer is not responsible, a pro rata refund is not possible.
Cancellation by the organizer/changes to programs
The organizer may cancel the event and withdraw from the contract if the required minimum number of participants has not been reached or if it is not possible to hold the event, for example due to restrictions imposed by regulations, because a speaker who is important for the success of the event is unable to attend due to illness or other reasons for which the organizer is not responsible, or because the rooms are not available due to force majeure.
The organizer reserves the right to change the festival programme, e.g. by offering suitable replacements for 5Rhythms teachers who are unable to attend or by postponing the schedule. In case of cancellation by the organizer, the paid fees will be refunded minus a fee of 50,00 € each.
Accommodation
Accommodation in the guest house will be in the room categories shown in the program. If your accommodation request cannot be met on the premises of the guest house, you will find information on independent accommodation options on the website.
Pets
Pets are not permitted. This does not apply to assistance dogs for the disabled. The owner is liable for any damage caused by the assistance dog. The owner is liable for any damage caused by the assistance dog.
Staying overnight in a tent or car
Overnight accommodation in a dormitory or in a tent brought along is only possible to a limited extent on the premises of Berufsvorbereitungswerk Ostalb gGmbH. With the confirmation of registration you will also be informed whether such accommodation is still possible. Overnight guests who are staying in their own car/motorhome or similar can use the parking spaces provided near the hall, the rooms in the guest house and the breakfast facilities. The schoolyard is not available as a parking space this year.
Liability
Any liability of the organizer and its auxiliary persons for personal injury and damage to property is excluded, except in cases of intent or gross negligence. Participation in the event constitutes acceptance of this exclusion of liability. The organizer is not liable for service disruptions, personal injury and property damage in connection with services that are merely arranged as third-party services.
If the organizer is forced to cancel an event, there is no entitlement to the event taking place. The organizer can also not be obligated to compensate for travel or accommodation costs, work loss costs or other claims. No liability is accepted for indirect damages, in particular loss of profit or third-party claims.
Liability for parked cars and items brought in
Insofar as a parking space is provided on the organizer’s premises, this does not constitute a safekeeping agreement. The organizer is not obliged to monitor the parking space. The organizer is not liable for damage to the vehicle caused in a parking space provided.
The organizer is not liable for damage, loss or theft of items and valuables brought in or brought along by guests. Items left behind will only be forwarded on request and at the expense and risk of the participant. The organizer undertakes to keep the items for two months.
Statute of limitations, data protection
Claims of the participant against the organizer, regardless of the legal grounds — with the exception of claims of the participant in tort — expire one year after the contractually agreed end date of the event.
Participants’ personal data will be carefully protected by the organizer. They are used to process the event and the booking processes. The data is also used to send information material from the organizer. Furthermore, personal data will not be passed on to third parties without consent.
Validity
All information on dates, prices, services and programs is correct at the time of printing/publication. We expressly reserve the right to make changes. Only written agreements are valid. No liability is accepted for printing errors. Should any of the above provisions be or become invalid, the remaining provisions shall nevertheless remain valid.
Organizer
The organizer is Dagmar Hanke, Leintalstr. 5, 73568 Durlangen in cooperation with Berufsvorbereitungswerk Ostalb gGmbH. The place of jurisdiction is the organizer’s registered office.
